Can I apply for permanent residence in the EU with job searching visa?

EU permanent residence (called “residencia larga duración-ue” in Spanish) is also known as EU permanent residence, EU permanent residence or EU residency. Although there are many different names, they are actually the same type of residence.

Note: EU permanent residence and EU family residence are two different concepts.

The first requirement to apply for EU residence is to have lived in Spain continuously and legally for 5 years or more. The minimum period of absence is 6 months within 5 years and the total period of absence cannot exceed 10 months.

Can I apply for permanent residence in the EU if I have job seeking visa?

You can apply for permanent residence in the European Union if you have lived in Spain legally for 5 consecutive years.

Since the work permit was formerly known as the student permit, it should be noted that, in theory, the period of residence as a student cannot be considered as legal residence. The term “legal residence” in the Spanish Aliens Act refers to residencia, while living in Spain as a student is called estancia.

Nevertheless, according to Article 152 of the Spanish Aliens Statute, the period of residence as a student is discounted by 50% for the purpose of applying for EU residence. In other words, if I have been in Spain for 4 years as a student, this period will count as 50% when applying for EU residence, i.e. 2 years.

According to the above calculation, to apply for permanent residence in the EU, you need to have 8 years of student residence plus 1 year of residence to find a job.

Do I need a work contract?

To apply for EU residence you need to prove that you are able to support yourself. The law requires the applicant to prove an average monthly income of 1 times the IPREM index (600 €/month). If the applicant has dependents, the income is increased by 50% of the IPREM index for each additional dependant. It is not mandatory to have a work contract.

If the applicant is a worker, then the best way is to submit documents such as pay slips, insurance policies or work contracts. If the applicant is the owner of a store, it is sufficient to submit various tax returns and RENTA. There is no strict law on what documents must be submitted in this regard, only that the applicant must prove that he or she has sufficient financial means.
