EU family residence card

The EU family residence is a type of residence exclusively for the family members of EU citizens. Family members include spouses, cohabiting partners, children or parents. 

If I have EU citizenship or if my spouse has EU citizenship, I can apply for EU family residence for my children. A step-parent who has EU citizenship can apply for EU dependent residence for their stepchildren. 

The first requirement for applying for EU family residence for a child is that the child is under 21 years of age. If they are over 21 years old, they need to prove financial dependence.

Documents needed to apply for EU family residence for children

 

-A completed official application form (EX-19). 

-A copy of the applicant’s entire passport. 

-EU citizen residence card. 

-Passport of the EU citizen. 

-Documents proving the kinship between the EU citizen and the applicant. For example, a birth certificate. If the step-parent has EU citizenship, then a notarized marriage between the step-parent and the biological parent is required.

-If the child is 21 years old, documents proving that the child is financially dependent on him or herself, or has a serious illness requiring care. 

-EU citizens have to provide proof of income. There are many ways to prove income, and the documents required vary depending on the situation. Compared to other residences, the Spanish government is more lenient about the financial capacity that needs to be proven for EU dependent residency, usually as long as there is an income. Nevertheless, the more detailed the documents, the better, so that the approval process is easier. Let’s talk about which documents are applicable in various cases: 

a) If you have a job in Spain, you will need to provide proof of any of the relevant documents. For example, a work contract, a pay slip or a social security policy. 

b) If you are engaged in a commercial activity in Spain, you can submit any of the same relevant certificates. For example, a certificate of social security for the self-employed or various tax documents. A

c) If you do not have a job or are not engaged in business activities, you will need to submit other types of proof. Such as bank deposits, investment funds, stocks, etc. In this case, it is necessary to provide a health insurance to prove that you will not be a burden to the Spanish health care system.
