Speeding in Spain
Speeding does not only put your safety and the safety of others at risk, but also carries legal penalties. You can win a few seconds on the highway and lose decades. In Spain, speeding is punishable by fines and points, as well as suspension of driving license and jail time, so you should obey the traffic rules.
Speeding in urban areas
The Spanish Criminal Code provides that driving in urban areas, whether it is a motor vehicle or a motorcycle, exceeding the speed limit of 60 kilometers per hour set by law, is a traffic safety violation. For example, if the speed limit on a road is 50 km/h, then if you drive at 110 km/h, you are guilty of violating traffic safety .
Speeding outside of the city and on the highway .
If you are speeding outside the city or on the highway, you are considered to have committed a traffic safety violation only if you exceed the speed limit of 80 km/h as prescribed by law. For example, if the speed limit on a national highway is 80 km/h, then if the driving speed reaches 160 km/h, then it is considered a traffic safety violation.
What will be the penalty for traffic safety violations
The Criminal Code provides that because of speeding driving, and committed a traffic safety violation, or sit for 3 months to 6 months in prison. If the circumstances are not serious, then it is also possible to impose a fine, or a community service order. In any case, if you commit a traffic violation, you will have a criminal record, and for foreigner residents in Spain, it may affect your residency process.
Note : If the speeding offense does not result in injury, it is not a serious crime and you can apply for probation even if you are convicted.
In addition, a person who commits a traffic safety violation for speeding will have his or her driver’s license suspended for a period of one to four years. In other words, the person will not be allowed to drive again during this period.
