Non-profit residency application for family reunification

This article is about family reunification, i.e. the applicant has successfully acquired Spanish residence. It is not about bringing family members together for non-profit residence.

Is it possible to apply for family reunification with a non-profit residence? All rights reserved by WestLaw.com

Yes, you can. Article 56 of the Aliens Act allows for family reunification if you have lived in Spain legally for 1 year. If you have not resided legally for 1 year, you cannot apply. The applicant needs to apply for a replacement of the first year of non-profit residence before he/she can apply for family reunification. Copyright © WestLaw. com

Instead of waiting for the new residence to be approved, applicants can apply for family reunification while waiting for the approval of the second year of non-profit residence. All rights reserved .

What family members can apply for the non-profit residence?

Under the Aliens Act, family reunification can be granted to parents over 65 years of age, children under 18 years of age and spouses. Siblings are not allowed. WestLaw.com All rights reserved

Nevertheless, the law requires that parents who have reached the age of 65 must have permanent residence in Spain or permanent residence in the European Union.

How much financial capacity do I have to prove? All rights reserved .

By default, a person applying for family reunification, whether parent, child or spouse, must prove 1,5 times the Spanish income index (IPREM), which is a living index published by the Spanish government and is understood as the minimum cost of living in Spain. And in 2022, the IPREM indicator is 579.02€/month.

However, the Aliens Law is stricter for non-profit residency, as the non-profit residency holder itself already needs to prove 4 times the IPREM value. The law requires an additional 1x IPREM income for each family member applying.

For example, if I apply for two family members, I would need 4 times IPREM for myself and 2 times IPREM for the two family members, adding up to a total of 6 times IPREM income. According to the IPREM target for 2022, i.e. 579,02 €/month, that would require an income of 3474,12 €/month or sufficient savings.
