Self emploted residence (cuenta propia)
Self-employed residence permit does not allow you to work as employee in other company. You should change to a work residence permit (cuenta ajena)
What are the conditions for changing to work permit?
According to Article 203 of the Spanish Aliens Statute
1.You can only apply for a change of residence to work residence after you have held a boss residence for one year or more.
2.The change of residence must be within the period of validity.
3. You may not start working until you have changed your work residence.
4.A work contract is required.
Documents you need
1.Official application form (Form EX-03, click to download ) Note: The work residence should be applied for by the company.
2.Photocopy of the entire passport.
3.Documents relating to the company: In the case of a self-employed person, a copy of the owner’s residence, or in the case of a registered company, a copy of the company’s by-laws with the tax number (NIF). It is also necessary to submit copies of the documents of the person who signed on behalf of the company (e.g. legal representative).
4.Work contract. A work contract is an employment agreement signed by the employer and the employee. The Spanish Ministry of Labor has a special template that can be filled out according to the agreement between the two parties.
5. The company’s tax returns. The main purpose is to prove the financial capacity of the company, but if possible, you can also submit additional documents such as bank statements, books of accounts, etc. Such documents will be provided by the company’s accountant.
Note: The returns bill submitted by the owner needs to prove sufficient financial capacity.
6.Proof of residence (padron). Although it is not explicitly stated in the law, many immigration offices will look at it as a rule.
7.In addition, the administrative fee payment form TASA-052 version (worker’s fee) and TASA 790-062 version (company fee) are required.

Other information
The resolution period is 3 months.
After the approval, you need to apply for a residence card (fingerprinting) within one month.
Note: During the resolution period, the applicant may not start working. Official work is required after successful approval of the work permit and social security.
