Job visa expired: How to apply for a 4-year residence permit

Extension of your first work residence permit

This article is about how to extend your work residence after the expiration of the initial validity period. After extesion, you will get a 4-year work residence card.

Note: Depending on your case, the validity of your initial work permit may be one year or two years.

Conditions to apply for 4-year residence permit

After you apply for an extension of your work residence, you will receive 4-year  residence. The conditions required are as follows:

1.No criminal record in Spain. If there is a criminal record, it should be cancelled beforehand. There is already an article on how to cancel a criminal record.

2.If you have children under 16 years old in Spain, study certificate is required.

3.Have worked at least 3 months per year in Spain.

Documents required for the extension of the work permit 

1.Official application form (EX-03). 

2.Copy of the complete passport. The reason for requesting the entire passport is to check the entry and exit stamps on it. The purpose is to confirm that the time limit for absence has not been exceeded.

3.If the applicant has children under 16 years old. A certificate of school attendance  (Certificado de matrícula) is required. This can be done in the secretariat of the school.

4. Work contract. If it is said that the applicant has not changed jobs since the first application for work residence, then it is not necessary to submit it again. Because the immigration office has your contract information registered.

If you have changed jobs, you should submit the new work contract. 

5. Pay slips. With a work contract you can prove the labor relationship, although there is no rule that you must have an extra document, it is recommended to submit the last 3 months pay slips so that you can better prove that you have a working income.

6. In addition, social security records (vida laboral) are required to prove that the social security conditions are met. Although the immigration office can retrieve the information themselves, proactive submission is helpful to quick approval.

7.If the applicant is not working, but is receiving unemployment benefits, you may need to submit proof of unemployment benefits.

9.Copy of your current residence card. 

10.In addition, although it is not mandatory to submit a certificate of residence (padron), it is recommended that you do so since the immigration office may ask for it. 

How do I apply? C

1.Applicants can submit documents in person at the immigration office or authorize a third person. Whether an appointment is required depends on the local immigration office scheduling. It is also possible to submit documents through the corresponding government registry (registro), which varies slightly from place to place. 

Currently, the immigration office has also developed a direct online submission, which requires an electronic certificate. 

2.The approval time is three months.
