I’m sure you’re not familiar with the Job Search Residence. Its purpose is to give students who have already graduated, an extra time (two years) to look for a job. And during the period of looking for a job, it is possible to legally live in Spain.

The residence permit is valid for 2 years (used to be 1 year) and cannot be extended. Therefore, you should find a job and exchange your job search residence for a work residence within this  2 years period, because the job search residence itself does not allow you to work.

What are the requirements to apply for work permit (also called job visa)?

1.You need to have a clean criminal record.

2.You need to have a work contract.

If you have a work contract that meets the requirements of the law, you can apply for a change of residence to a work permit.

Documents you need to exchange to a work permit

1.Official application form (Form EX-03, click to download ) Note: The application for work residence should be made by the company or the employer and not by the student himself/herself.

2.Copy of the entire passport.

3.Documents related to the company: In the case of a self-employed person, a copy of the owner’s residence, or in the case of a registered company, the company’s incorporation deed with the tax number (NIF). It is also necessary to submit copies of the documents of the person who signed on behalf of the company (e.g. legal representative).

4.Work contract. A work contract is an employment agreement signed by the employer and the employee. The Spanish Ministry of Labor has a special template that can be filled out according to the agreement between the two parties.

5. The company’s or  employer’s tax returns. The main purpose is to prove the financial capacity of the company, but if possible, you can also submit additional documents such as bank statements, books of accounts, etc. Such documents will be provided by the company’s accountant or firm.

Note: The tax returns submitted by the owner needs to prove sufficient financial capacity.

6.Proof of residence (padron). Although not explicitly stated in the law, many immigration offices routinely check the applicant’s residence.

Note: It is not necessary to prove that you have lived in Spain for 3 years. 

7.In addition, at the time of application, the administrative fee payment form TASA-052 version (worker’s fee) and TASA 790-062 version (company fee) are required.

Resolution timing

The approval time is 3 months more or less.

After the approval, you need to apply for a residence card (fingerprinting) within one month.

Note: During the resolution period, the applicant may not start working. Official work is required after successful approval of the work permit and social security.
