Residence for newborns

In this article, we deal with how to apply for residence for a newborn child born in Spain. According to article 185 of the Spanish Aliens Act, immigrants with legal residence in Spain who give birth to a child in Spain will receive the same type of residence as the child’s parents.

Note: This article does not apply to children who were not born in Spain.

What are the requirements for the newborn’s residence?

It is sufficient for one of the parents to have a residence permit.

This does not apply if both parents do not have residenc. In this case, the newborn is not entitled to get the residence permits.

Note:

1.The type of residence of a newborn child will follow the parents’.

2.If the type of residence of both parents is different, it will follow any of te parents at your will. For example, if the father is a permanent resident and the mother has work permit. In this case, it would be better that the child also have permanent residence.

Dcouments you need

1.Application form, which requires the signature of one of the parents. The application form varies depending on the type of residence of the dependent person:

a) If the parents have temporary resident (including work permit, self-employed permit etc.), the EX-01 form (Solicitud de autorización de residencia temporal no lucrativa) is required. Click here to download.

b) If the parents have permanent resident, the EX-11 form ( Solicitud de autorización de residencia de larga duración o de larga duración-UE) is required. Click here to download. 

2.Copy of the entire newborn’s passport. Y

3.Birth certificate (Certificado de nacimiento).

4.Original and photocopy of the parents’ residence card.

5.Proof of residence (padron).

6. Administrative fee payment form TASA 790-052.

Note: When filling out the 790-052, if the parents have temporary residence permit you need to select option 2.1 “autorización inicial de residencia temporal”, and if it is a permanent resident, select item 2.6 “autorización de residencia de larga duración y autorización de residencia de larga duración-UE”.

3.The approval time is 45 days.

4.You need to go to the fingerprinting within 30 days after receiving the approval letter. All rights reserved . Reproduction by individuals or organizations is prohibited.

Online application is also possible if you have digital certificate.
