Residence card renewal period

As stated in Spanish Immigration Law, in general, the residence permit renewal period ranges from 60 (calendar) days before or 90 (calendar) days after the expiration of your residence card.

It is important to note that the concept of 90 days is not the same as 3 months, because some months have 31 days and some, like February, have 28 days. Although the difference in the number of days is not significant, it is important to be careful.

You cannot extend your permit after 90 days from expiry date

You cannot apply for an extension of your residence permit if it has expired for more than 90 days. How should I count these 90 days?

For example, if my residence expired on January 1st, then January 2nd is the first day, so you can count up to the 90th day, which is the last day you can apply for an extension. After that date, the application for residence will not be accepted and you will be considered as illegally staying in Spain and will have to leave the country, as stated in article 24 of the Spanish Immigration Law. 

It is possible to extend permanent residence after 90 days

In fact, there is one exception to the above rule. According to article 150 of the Spanish Aliens Act, if the holder of a permanent residence (larga duración) does not apply for an extension after 90 days from the expiry date, the residence will not be annulled and the holder will remain in Spain with legal status. The late application for extension will also be accepted.

In this regard, the law does not stipulate the maximum delay allowed. Anyway, the sooner you apply for the extension, the better.
