According to article 7 of the Spanish Foreigners’ Statute, after the expiration of your residence, you can no longer enter Spanish territory with it. If you want to leave Spain for a trip or for some reason and your stay will expire on the date you expect to return, you can apply for a Return Permit (also known as “autorización de regreso” in Spanish).

With this permit, you will be able to enter Spain even if your stay has expired. According to Article 5 of the Spanish Law on Foreigners, you can apply for a Return Permit if you are still in the process of applying for an extension of your stay or residence permit (en trámite), or if you have been granted a residence permit and have not yet received it.

What is a regreso?

If your stay in Spain is being approved or extended, you can apply for a regreso as an important document for your temporary departure from Spain and your return to Spain at the end of your trip. It is the equivalent of a temporary residence card to enter and leave Spain.

In which cases can I apply for a Home Return Permit?

  1. If you have a legal residence in Spain and your residence is being renewed.

Note: If you do not have legal residence at the moment, but are only in the process of approval for the first time, then you cannot apply for a Return Permit. This is because it is only valid for the period of extension or replacement of residence.

2. The residence has been approved, but you have not yet received your official residence card. This situation is also used for first-time residence applications.

For example, if you are applying for a residence permit for the first time and your residence is being approved, you cannot apply for a Home Visit Permit, but if your residence has been approved and you have been fingerprinted, but you have not received your card, you can apply for a regreso. In this case, the applicant will need to provide proof of a valid reason for leaving Spain.

Can I apply for a regreso during my residence appeal?

Based on previous experience and feedback from users, most of the immigration offices allow the application for a residence permit during the administrative appeal. In the case of a judicial appeal in a lawsuit, since the law is not written, most of the immigration offices around the country refuse the application.

Documents required for regreso application

-Completed application form (EX-13 version).

-A copy of the whole passport.

-The receipt of the application for extension of residence permit, i.e. the application form that was stamped when the application was made.

If the residence permit has been approved, a letter of approval is required.

If you have already been fingerprinted, but have not received your card, then submit a receipt for the fingerprinting.

-Administrative payment slip MODELO TASA 790. Note: The return card, depending on the area, can be applied for at the police station or at the immigration office. If you apply at a police station ( Comisaría de policía ), you will need to use TASA 790-012, and you will need to select “Autorización de regreso.” when filling out form 790 012.

If the application is made at the immigration office, you will need to use TASA 790-052. When filling out form 052, select item 6.3: Autorización de regreso.

Do I need to show my flight ticket ?

Normally, you do not need to present an airline ticket to apply for a regreso. However, if your case is that your residence has been approved, but you have not yet received your official residence card. In this case, according to article 5 of the Aliens Statute, the applicant will need to provide proof of a valid reason for leaving Spain. Of course, the best proof is to show proof of the airline ticket or the accommodation for the trip abroad.

In addition, if you have an emergency and want to get your home return permit as soon as possible, presenting your airline ticket will allow the staff to take into account the time of the ticket and give priority to your home return permit application as soon as possible. Of course, the implementation will be different for each immigration office, and in stricter areas, you may not be given urgent processing even if you present your airline ticket.

If you are in possession of documents in a foreign language, they must be translated into Spanish or the relevant official language used by the local Spanish authorities, such as Catalan. 

How to apply for a regreso

-The application form can be submitted in person or on behalf of someone else at the immigration office or police station in the area where you live.

-The appropriate administrative fee (TASA 790) must be paid prior to submission.

-The applicant must collect the return permit in person.

-The return permit is valid for 90 days.

Note: The need to make an appointment to apply for a regreso depends on the local police station or immigration office. Usually, if the applicant is in a hurry to leave the country and has a valid reason, he/she can request an emergency processing without an appointment.

Important notes

-Expired regreso will result in denial of entry. All rights reserved.
-Regreso is a document issued by the Spanish government and does not have international validity. It only allows its holder to leave and enter Spain. Therefore, it is advisable to take a direct flight to your destination when leaving the Spanish territory.
-According to the above, you need to be careful when traveling to multiple countries with a regreso permit. This is because third countries may not recognize the document issued by the Spanish government.
