EU family residence permit

It is possible to obtain residence permit as parejo de hecho (stable couple) of a Spanish or EU citizen.

The official name of this type of residence permit is “EU family member residence card”.

Under EU law, anyone who is related to a citizen of any EU country can apply for EU family residence in the country where he or she lives. Family relations include parents, children, spouses, etc. This also includes partners in a stable relationship.

How long do I have to live together before I can apply for EU family residence?

The law requires documents to prove cohabitation. Therefore, cohabiting partners should register their cohabitation with the local authorities. This is because with the registration of cohabitation, the relationship is officially recognized. After the registration is completed, the government office will issue a “certificate of pareja de hecho“. With this certificate of cohabitation, you can go to the immigration office to apply for EU family residence.

Note: The certificate of cohabitation should be obtained at the local regional office or city hall. The requirements for this vary from place to place. You should ask for it yourself. Nevertheless, the general requirements are as follows:

1.It is necessary for both cohabitants to prove that they actually live together. This can be done using a certificate of residence (padron).

2.In some places, it is required that both parties have lived together for a certain period of time, such as three months or six months.
